Terms & Conditions of Sale

By purchasing products from http://artandfoundation.com/, the Artand Publishing Pty Ltd website (Site), the purchaser (Customer) agrees to the following Terms & Conditions of Sale.

1. Ordering
On the Customer confirming their order, the Customer agrees to purchase the products in their ‘shopping cart’ for the price including GST and any postage and handling charges, as applicable.
 Artand Publishing Pty Ltd will send the products to the Customer as soon as practicable after it receives payment for the products.
The Customer warrants that it will not purchase products for the purpose of commercial resale.

2. Returning products
To return a product purchased from the Site, please contact our Customer Service Department via assistant@ARTANDaustralia.com or phone tollfree (Australia only) 1800 224 018 or internationally 61 2 9331 4455.

Artand Publishing Pty Ltd will either (i) refund, (ii) replace the product or (iii) exchange products purchased, provided the products are returned within 14 days, in good condition, and accompanied by the official invoice. When returning products, Artand Publishing Pty Ltd will cover only the cost of freight for products that are faulty. Freight costs for all other returns are at the expense of the Customer.

3. Faulty products
If the Customer purchases a faulty product from Artand Publishing Pty Ltd, the Customer must return the product to Artand Publishing Pty Ltd within 14 days of receiving the product, with a copy of the invoice for the product and a brief letter that includes the Customer’s details and identifies the fault in the product.
If the product is faulty, Artand Publishing Pty Ltd will, in its discretion, either
 (i) replace the product or 
(ii) provide a refund of the price of the defective product to the Customer. Artand Publishing Pty Ltd will not accept any liability for any defective products that the Customer does not return in accordance with Clause 2.
 In no case shall the maximum liability of Artand Publishing Pty Ltd exceed the price of the product in respect to which a claim is made.

4. Stock availability
The Customer shall not be entitled to object if information about products on the Site is not correct or if advertised products are not available or if images of products differ from the actual products. If the Customer pays for a product that Artand Publishing Pty Ltd cannot supply, Artand Publishing Pty Ltd will refund the price of that product to the Customer.

5. Products sent to incorrect address
If the Customer does not receive products it has purchased within 30 days of the date of purchase Artand Publishing Pty Ltd shall not be liable to the Customer for those products unless the Customer notifies Artand Publishing Pty Ltd within 30 days of the date of purchase. 
If a product is not received by a Customer because it was sent by Artand Publishing Pty Ltd to an incorrect address due to an error by Artand Publishing Pty Ltd then Artand Publishing Pty Ltd shall be responsible for the resending or replacement of the product or refunding of the price of the product.
 If a product is not received by the Customer because the Customer provided an incorrect or insufficient address, then
 (i) subject to clause 6, if the product is returned to Artand Publishing Pty Ltd, Artand Publishing Pty Ltd will resend the product to the Customer provided that the Customer first pays the cost of postage and handling for resending; or
 (ii) if the product is not returned to Artand Publishing Pty Ltd, then Artand Publishing Pty Ltd shall have no further responsibility.

6. Non-claimed products
If products that a Customer has purchased are returned to Artand Publishing Pty Ltd by a person other than the Customer and Artand Publishing Pty Ltd cannot, despite reasonable efforts, contact the Customer or the Customer does not contact Artand Publishing Pty Ltd within 3 months of products being returned to Artand Publishing Pty Ltd, then ownership of the products will revert to Artand Publishing Pty Ltd.

7. Delays
The Customer agrees not to hold Artand Publishing Pty Ltd liable for any loss or damage directly or indirectly arising out of or in connection with any delay or failure to deliver within the estimated time frame.

8. Customs and import duties
When ordering products for delivery outside Australia, the Customer may be subject to import duties and taxes levied once the package reaches the country of destination. Any such additional charges must be borne by the Customer. Artand Publishing Pty Ltd has no control over these charges.

9. Passing of risk and ownership
Subject to Clause 5, ownership of products purchased by the Customer shall pass to the Customer on Artand Publishing Pty Ltd sending the products to the Customer.

10. Limitation of liability
Artand Publishing Pty Ltd shall not be liable to the Customer for refunding the price of products or replacing or exchanging products that the Customer purchases through the Artand Publishing Pty Ltd, other than as set out in these Terms & Conditions of Sale. Artand Publishing Pty Ltd shall not be liable to the Customer for any incidental, indirect, special or consequential damages arising out of or in connection with the purchase, use, or performance of products or services that the Customer purchases through Artand Publishing Pty Ltd, even if Artand Publishing Pty Ltd has been advised of the possibility of such damages.
